Terms of Use

Please read these Terms of Use carefully before using The PopRecord. By accessing or using this site, you agree to be bound by these terms. If you do not agree, please do not use the site.

1. About The PopRecord

The PopRecord ("PopRecord," "we," "us," or "our") is operated by PopDrop LLC, a Washington State limited liability company. PopRecord is a public transparency database that analyzes publicly available data signals about Spotify artists to surface patterns that may be associated with AI-generated music or AI music farm operations.

Important: The PopRecord is not affiliated with, sponsored by, endorsed by, or in any way officially connected with Spotify AB. "Spotify" is a registered trademark of Spotify AB. PopRecord uses the Spotify Web API in accordance with Spotify's Developer Terms to access publicly available artist metadata only.

2. Nature of Our Assessments

This section is the most important part of these Terms. Please read it carefully.

2.1 Probabilistic Analysis, Not Factual Determinations

All artist assessments published on PopRecord — including confidence tiers, signal breakdowns, AI reasoning bullets, and classifications — are probabilistic analyses based on publicly available data signals. They are not statements of fact. They are not determinations that any artist is definitively AI-generated, fraudulent, or inauthentic.

PopRecord surfaces patterns that may be associated with AI generation. Many signals that appear suspicious in isolation have legitimate explanations. An artist classified as "Likely AI Generated" may be a real human artist. An artist classified as "Likely Human" may, in fact, be AI-generated. Our analysis is imperfect by design and by honest acknowledgment.

2.2 Not Legal, Financial, or Professional Advice

Nothing on PopRecord constitutes legal advice, financial advice, defamation, or a professional determination of any kind. PopRecord assessments should not be relied upon as the basis for any legal claim, business decision, or professional action against any artist, label, distributor, or individual.

2.3 Informational Purpose Only

PopRecord exists to provide music listeners with information to make their own informed choices. Our assessments are starting points for inquiry, not conclusions. We encourage users to conduct their own research and to use the community input and appeal pathways if they have information that changes the picture.

2.4 Caveats Are Integral to Every Assessment

Every artist profile on PopRecord includes a caveat stating that our analysis is not definitive and that we are open to being wrong. These caveats are not boilerplate — they are a core part of how PopRecord communicates. Any reproduction or sharing of PopRecord assessments must include these caveats to accurately represent the nature of our analysis.

3. Acceptable Use

By using PopRecord, you agree that you will not:

  • Use PopRecord assessments to harass, defame, or make false factual claims about any artist, individual, label, or distributor
  • Present PopRecord assessments as definitive factual determinations rather than probabilistic analyses
  • Use PopRecord to systematically scrape, harvest, or compile artist data for commercial purposes
  • Attempt to manipulate PopRecord's analysis queue, signal data, or assessment outcomes through fraudulent searches or submissions
  • Submit false information through community input or appeal forms
  • Use PopRecord for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any part of PopRecord's systems
  • Reproduce PopRecord assessments in a misleading way that strips the probabilistic caveats from the content

4. Community Input and Appeals

4.1 Accuracy of Submissions

By submitting information through our community input or appeal forms, you represent that the information you provide is accurate and truthful to the best of your knowledge. Submitting knowingly false information is a violation of these Terms.

4.2 No Public Visibility

Community input submissions and appeal submissions are not published publicly. They are reviewed by PopRecord administrators and our AI triage system. We make no guarantee as to the timeline of review or the outcome of any submission.

4.3 Appeal Outcomes

PopRecord will review all artist appeals in good faith. We make no guarantee that any appeal will result in a change to an artist's confidence tier. Our determination following an appeal is final. Artists who successfully verify their identity will receive a "Verified Human" designation on their profile.

4.4 License to Submissions

By submitting information to PopRecord, you grant PopDrop LLC a non-exclusive, royalty-free, worldwide license to use that information for the purpose of improving artist assessments on PopRecord. We will not use submission content for any other purpose.

5. Intellectual Property

5.1 PopRecord Content

The PopRecord name, logo, site design, and original written content (including our AI-generated assessment copy) are the property of PopDrop LLC. You may not reproduce, distribute, or create derivative works from PopRecord content without our written permission, except for fair use purposes such as commentary, criticism, and news reporting — provided that any such reproduction includes our probabilistic caveats and does not misrepresent our assessments as factual determinations.

5.2 Third Party Data

Artist metadata displayed on PopRecord is derived from publicly available sources including the Spotify Web API, MusicBrainz, and Last.fm. These sources have their own terms of service and intellectual property rights. PopRecord does not claim ownership of underlying artist data from these sources.

5.3 Artist Images

Artist profile images displayed on PopRecord are sourced from the Spotify Web API and are the property of their respective rights holders. They are displayed for identification and analysis purposes only under fair use.

6. Disclaimers and Limitation of Liability

6.1 Disclaimer of Warranties

THE POPRECORD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. POPDROP LLC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. POPDROP LLC DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ARTIST ASSESSMENT OR SIGNAL DATA.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POPDROP LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF REPUTATION, OR DAMAGE TO BUSINESS RELATIONSHIPS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF POPRECORD OR ANY ARTIST ASSESSMENT PUBLISHED ON POPRECORD, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL POPDROP LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF POPRECORD EXCEED ONE HUNDRED DOLLARS ($100).

6.3 Assessment Liability Disclaimer

PopRecord assessments are probabilistic analyses, not statements of fact. PopDrop LLC expressly disclaims any liability for harm to any artist, individual, label, or distributor arising from a PopRecord assessment. If you believe a PopRecord assessment is inaccurate or harmful, the appropriate remedy is to use our appeal pathway, not legal action. We take appeals seriously and review them in good faith.

7. Indemnification

You agree to indemnify, defend, and hold harmless PopDrop LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of PopRecord; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your submission of false or misleading information through our community input or appeal forms.

8. Third Party Links and Services

PopRecord may contain links to third-party websites or services, including Spotify artist profiles. These links are provided for convenience only. PopDrop LLC does not endorse and is not responsible for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is governed by their own terms and policies.

9. AI-Generated Content Disclosure

PopRecord uses the Anthropic Claude AI model to generate artist assessment text, including confidence tier recommendations, reasoning bullets, and summary statements. This AI-generated content is clearly labeled as such on every artist profile. AI-generated assessments are reviewed against signal data but are not manually verified for every artist. PopDrop LLC is responsible for the use of AI in our analysis pipeline and for the content published on PopRecord.

10. Changes to the Service

We reserve the right to modify, suspend, or discontinue PopRecord at any time without notice. We may update artist assessments as new signal data becomes available or as our analysis methodology improves. We may remove artist profiles if we determine that continued publication is inappropriate. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

11. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of material changes by updating the effective date at the top of this page. Your continued use of PopRecord after changes are posted constitutes your acceptance of the updated terms. If you do not agree to the updated terms, please stop using PopRecord.

12. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of PopRecord shall be resolved exclusively in the state or federal courts located in Washington State. You consent to the personal jurisdiction of such courts.

Before initiating any legal proceeding, you agree to contact us at legal@thepoprecord.com and give us 30 days to attempt to resolve the dispute informally.

13. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and PopDrop LLC regarding your use of PopRecord and supersede any prior agreements or understandings.
